Terms of Service

These Terms of Service ("Terms") apply to everyone who uses the Arknx website, the Arknx app and the Arknx Vendor app (together, the "Platform"), operated by Arknx Technologies Private Limited ("Arknx", "we", "us" or "our"), a company incorporated under the Companies Act, 2013, with its principal place of business in Bengaluru, Karnataka.

1. Accepting these Terms

By creating an account and selecting "I Agree" (or a similar option), you enter into a binding electronic contract with Arknx under the Information Technology Act, 2000. We record the date and version of the Terms you accept. If you do not agree to these Terms, please do not use the Platform.

2. Your account

• You must be 18 or older to use the Platform.
• You must give accurate, current and complete information, including your vehicle details.
• You sign in with a one-time password (OTP) sent to your mobile number. You are responsible for all activity on your account.

3. Our role

Arknx is a technology platform that connects drivers with owners and operators of parking spaces ("Vendors"). Parking spaces are provided by Vendors, not by Arknx. We do not own or operate the spaces listed on the Platform.

4. Booking and paying for parking

• Bookings are made in advance through the app. Rates are set by each Vendor and may vary by location, vehicle type and time.
• You pay the amount shown before you confirm a booking, including any applicable taxes. Payments are processed by our payment partner, Razorpay, and Arknx collects payments on behalf of Vendors.
• Show your booking QR code at the entry gate. If you stay longer than booked, the extra time is charged at the space's hourly rate when you exit.
• Cancellations and refunds are covered by our Refund & Cancellation Policy.

5. Using parking spaces

• Follow the Vendor's parking rules, posted instructions and all local traffic laws.
• Park only in the space and for the time you booked.
• You are responsible for your vehicle and anything inside it. Arknx is not responsible for damage to or theft of vehicles or belongings while parked.

6. Vendors

• Vendors must own the space they list, or have the owner's permission to list it.
• Vendors must provide accurate details, rates and opening hours, and keep them up to date.
• Every listing is reviewed and must pass document verification before it is shown to drivers. We may refuse, pause or remove a listing that does not meet our standards.
• Vendors are responsible for the condition and safety of their space and for complying with local laws, including any permits their space needs.

7. Acceptable use

You must not use the Platform for anything fraudulent or unlawful, make fake bookings, misuse promotional offers, interfere with the Platform's security, or copy, modify or reverse-engineer the Platform. We may suspend or close accounts that break these Terms.

8. Intellectual property

The Platform, including its software, design, branding and content, belongs to Arknx Technologies Private Limited. These Terms do not give you any right to use our trademarks or content except as needed to use the Platform.

9. Privacy

We collect and use your personal data as described in our Privacy Policy, in line with applicable Indian law, including the Digital Personal Data Protection Act, 2023.

10. Limitation of liability

To the extent permitted by law, Arknx is not liable for any indirect, incidental or consequential loss arising from your use of the Platform or of any parking space booked through it.

11. Changes to these Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, where appropriate, ask you to accept the new version in the app.

12. Governing law

These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
